BritBox Candidate Privacy Notice
This notice explains how we collect, store and use your personal information when you apply to work for us (whether as an employee, secondee, worker or contractor), and your rights in respect of that personal information.
This BritBox careers site is operated by one of the following members of the BritBox group (“we”, “us” or “our”), depending on where you are as a user:
- For users in the UK: the BritBox entity that operates this site and is the controller of and responsible for your data is BritBox International Limited and/or BritBox International Trading Limited registered in England and Wales
- For users in the US: the BritBox entity that operates this site and is responsible for your data is BritBox, LLC, a company registered in the State of New York, USA
- For users in Australia: the BritBox entity that operates this site and is responsible for your data is The BritBox Australia Partnership (ABN 49 274 475 031), acting through its agent BritBox Australia Management Pty Limited (ACN 643 196 141).
When we refer to applicable data protection laws in this policy, we mean the data protection laws that apply to you because of where you are. For example, if you are in UK, this will include the General Data Protection Regulation (GDPR), and if you are in Australia this will include the Australian Privacy Act.
If you are applying to work for BritBox in Australia, the BBC group will also process your personal information during the application process. This policy may be updated from time to time.
1. What information do we hold about you?
In connection with your application for work with us, we will collect, store, and use the following categories of personal information about you:
- Your name, address and contact details
- Information from your CV including your employment history and qualifications
- Information about your current level of remuneration and benefits
- Information you provide to us during an interview or phone screening
- Information about your entitlement to work in the country in which the role you are applying for is based
We may also collect, store and use the following sensitive personal information, for the purposes further described below:
- Information about your race or ethnicity, religious beliefs, sexual orientation or socio-economic background
- Information about your health, including disability status
- Information about criminal convictions and offences
2. How is your personal information collected?
We collect personal information about candidates from the following sources:
- You, the candidate
- Any recruitment agency through which you have applied for the role
- Any third-party platform such as LinkedIn or the BritBox International careers portal through which you have applied for the role
- Your named referees
3. How will we use your personal information?
We will use the personal information we collect about you to:
- Assess your skills, qualifications, and suitability for the role
- Communicate with you about the recruitment process
- Keep records related to our hiring processes
- Carry out background and reference checks, where applicable
- Comply with legal or regulatory requirements
We only use your personal information when the law allows us to. Most commonly, we will use your personal information where it is in our legitimate interests to decide whether to appoint you to the role you are applying for. If your application is successful, we will also need to process your personal information in order to enter into a contract of employment or services with you.
If you fail to provide information when requested, which is necessary for us to consider your application, we will not be able to continue processing your application.
4. How will we use particularly sensitive personal information about you?
We will use your sensitive personal information in the following ways:
- We will use information about your disability status to consider whether we need to provide appropriate adjustments during the recruitment process.
- We will use information about your race or ethnicity, religious beliefs, sexual orientation, disability status or socio-economic background to ensure meaningful equal opportunity monitoring and reporting.
5. How will we use information about criminal convictions?
We may collect information about your criminal convictions history if we would like to offer you a role (conditional on checks and any other conditions, such as references, being satisfactory), in order to satisfy ourselves that there is nothing in your criminal convictions history which makes you unsuitable for the role. We will only collect information about criminal convictions if it is appropriate given the nature of the role, and we are legally required or entitled to do so. We have in place appropriate safeguards which we are required by law to maintain when processing such data.
6. Why might you share my personal information with third parties?
We will only share your personal information with third parties for the purposes of processing your application, including our third-party service providers, other members of the BritBox group of companies, and related BBC companies. Third parties are required to take appropriate security measures to protect your personal information in line with our policies. We do not allow our third-party service providers to use your personal information for their own purposes.
7. How will my information be stored?
We have put in place appropriate security measures to prevent your personal information from being lost, used, altered, disclosed or accessed in an unauthorised way. In addition, we limit access to your personal information to those employees, agents, contractors and other third parties who have a business need-to-know and are subject to a duty of confidentiality.
We may transfer the personal information we collect about you to our suppliers (including the supplier of our applicant tracking system) and/or other entities in the BritBox International or BBC group located outside the country in which you are resident, solely for the purpose of performing our contract with you.
We have put in place appropriate measures which are designed to ensure that your personal information is treated in a way that is consistent with and which respects applicable laws on data protection when transferred to those countries.
8. How long will you use my information for?
Your personal information will be stored in accordance with applicable laws and kept as long as needed to carry out the purposes described in this notice (or as otherwise required by applicable law). If your application is successful, your personal information will be retained in accordance with our Staff Privacy Notice. If your application is unsuccessful, we will retain your personal information for the duration of the application process plus a reasonable period so that we can show, in the event of a legal claim, that we have not discriminated against candidates on prohibited grounds and that we have conducted the recruitment exercise in a fair and transparent way. After this period, we will securely destroy your personal information in accordance with applicable laws and regulations.
We may retain your contact information so that we can contact you in respect of future roles at BritBox that you might be interested in. If you would prefer that we do not contact you for these purposes, please let us know by updating your communications preferences on the BritBox careers portal or contacting us at the details set out below.
9. Your rights in connection with your personal information
Under certain circumstances, and depending on where you are resident, you may be able to exercise the following rights under applicable data protection laws:
- Request access to your personal information (commonly known as a "data subject access request"). This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.
- Request correction of the personal information that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected.
- Request erasure of your personal information. This enables you to ask us to delete or remove personal information where there is no good reason for us continuing to process it.
- Object to processing of your personal information where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground.
- Request the restriction of processing of your personal information. This enables you to ask us to suspend the processing of personal information about you, for example if you want us to establish its accuracy or the reason for processing it.
- Request the transfer of your personal information to another party.
You will not have to pay a fee to exercise any of these rights. However, we may charge a reasonable fee if your request for access is clearly unfounded or excessive. We may also refuse to comply with the request in these circumstances.
We may need to request specific information from you to help us confirm your identity. This is an appropriate security measure to ensure that personal information is not disclosed to any person who has no right to receive it.
